By accessing or using AdaQuiz ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

AdaQuiz is an interactive programming quiz platform that helps users master programming languages through adaptive learning, spaced repetition, and AI-generated questions.

The Service includes:

• Programming quizzes for JavaScript, Python, Go, Rust, Java, and C++
• Spaced repetition algorithm for optimal learning
• Progress tracking and performance analytics
• Free and paid subscription tiers

Account Creation

To use AdaQuiz, you must:

• Be at least 13 years of age
• Provide accurate and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account

Account Security

You are responsible for:

• Keeping your password confidential
• Notifying us immediately of unauthorized access
• All actions taken through your account

Account Termination

You may delete your account at any time through Settings. We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

Free Tier

• 1 quiz per day
• Up to 25 questions per quiz
• Easy and Medium difficulty levels
• Basic progress tracking

Plus Tier ($5.99/month)

• 5 quizzes per day
• Up to 25 questions per quiz
• All difficulty levels (Easy, Medium, Hard)
• Basic statistics

Pro Tier ($9.99/month)

• 15 quizzes per day
• Up to 40 questions per quiz
• All difficulty levels
• Advanced insights and performance trends
• Weakness detection
• Data export (JSON/CSV)

Billing

Subscriptions are billed monthly on a recurring basis. Payment is processed through DodoPayments. You can cancel your subscription at any time through Settings.

No Refunds: All subscription fees are non-refundable. When you cancel a subscription, you retain access until the end of your current billing period.

Exceptions: Refunds may be provided at our sole discretion in cases of:

• Technical errors resulting in duplicate charges
• Service unavailability for extended periods
• Unauthorized charges

To request a refund exception, contact us at support@adaquiz.online within 7 days of the charge.

You may cancel your subscription at any time through Settings → Subscription Management.

Upon cancellation:

• You retain access until the end of your current billing period
• No further charges will be made
• Your account will revert to the Free tier after expiration
• All quiz history and progress will be retained

Our Content

All content on AdaQuiz (quiz questions, explanations, software, design, trademarks) is owned by AdaQuiz or its licensors and protected by copyright, trademark, and other intellectual property laws.

Your Data

You retain ownership of your quiz history, answers, and performance data. By using the Service, you grant us a license to use this data to:

• Provide and improve the Service
• Generate personalized learning recommendations
• Create aggregated, anonymized analytics

User Submissions

When you report questions or provide feedback, you grant us a perpetual, worldwide license to use, modify, and incorporate your submissions to improve the Service.

You agree NOT to:

• Share your account credentials with others
• Use automated tools to access the Service (bots, scrapers)
• Attempt to reverse engineer or extract quiz questions
• Circumvent rate limits or subscription restrictions
• Distribute or sell quiz content
• Use the Service for illegal purposes
• Harass, threaten, or harm other users
• Upload viruses or malicious code
• Create multiple accounts to abuse free tier limits

Violation of these prohibitions may result in immediate account termination without refund.

Some quiz questions are generated using AI (OpenAI GPT). While we strive for accuracy:

• AI-generated questions may contain errors or inaccuracies
• You can report problematic questions through the "Report Issue" feature
• We review and moderate reported questions
• AdaQuiz is for educational purposes and should not be the sole learning resource

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of content
• Uninterrupted or error-free operation
• Security of data transmission

We do not guarantee that quiz questions are error-free or that the Service will meet your learning objectives.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADAQUIZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Service interruptions or data breaches
• Reliance on quiz content for job interviews or exams
• Errors in AI-generated questions

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.

You agree to indemnify and hold AdaQuiz harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Violation of these Terms
• Infringement of any third-party rights
• Content you submit or report

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues that temporarily affect availability.

We reserve the right to:

• Modify or discontinue features at any time
• Change subscription pricing with 30 days' notice
• Update content and quiz questions

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. The Service is operated from India and uses infrastructure located in various jurisdictions including the United States.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Trivandrum, Kerala, India. You agree to submit to the personal jurisdiction of such courts.

For users outside India, you agree that these Terms are governed by Indian law and consent to jurisdiction in India for any disputes.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
